After discovery, if it doesn’t get thrown out on summary judgment, it goes to trial. If it doesn’t get thrown out on a motion to dismiss, the lawsuit states a valid legal claim. If it doesn’t get thrown out on summary judgment, there is evidence to support the claim. Either way, if it doesn’t get thrown out, it’s literally not a frivolous case.
